At an inquiry held in Port Elizabeth on 18 October 2019, Jockey Donald Bogaleboile was charged with a contravention of Rule 21.11, in that as the Rider of TEQUILA MARIA in Race 2 at Fairview Racecourse on 2 August 2019, he failed to ensure that this filly carried the correct weight during the running of the race, by weighing in at more than 0.5 kg below the weight at which he was declared out at. This resulted in TEQUILA MARIA being disqualified following an objection by the Clerk of Scales being upheld.
A plea of not guilty was entered on behalf of Jockey Bogaleboile, however, he was found guilty as charged.
After considering all mitigating and aggravating evidence, which included the finishing position of TEQUILA MARIA, the extent of the underweight and the form of TEQUILA MARIA, the Inquiry Board imposed a fine of R5000, of which R3000 is suspended for a period of 12 months, on condition that he is not found guilty of a similar contravention during this period.
Jockey Bogaleboile was afforded the Right of Appeal against the finding and the penalty imposed.
