Protection of Information Employees Consent Form

I, acknowledge that the National Horseracing Authority (“NHA”) may process my personal information in terms of the Protection of Personal Information Act no 4 of 2013 (“POPIA”).

  1. I hereby provide my voluntary and informed consent for the NHA to process my personal information (as defined in the Protection of Personal Information Act 4 of 2013 (‘the Act’)) in accordance with the Act and in terms of the NHA’s policies that are available to all employees, and only to the extent necessary to discharge its obligations and perform its functions as an employer. For this purpose you acknowledge that my personal information will be processed in inter alia human capital management systems, payroll systems, learning management systems, employee benefit systems and various statutory and regulatory reporting systems.
  2. The NHA will delete or de-identify my personal information that has been collected from me if it is no longer needed for any purpose related to your employment. I acknowledge that I have the right to request access to and correction of my personal information that we have collected from pursuant to my employment.
  3. I acknowledge that the NHA may be required to transfer my personal information to locations outside of South Africa. Such transfers will occur in compliance with applicable local law relevant to the source of the information, but may result in a transfer of my personal information to a jurisdiction that does not have the same or a better level of data protection compared to South Africa. To the extent that such transfer is required or is necessary to perform in terms of this contract of employment, I hereby provide my voluntary and informed consent to the transfer of my personal information by the Company outside of South Africa.
  4. I undertake and agree to:
    1. provide the NHA with necessary personal information that facilitates my employment with the Organisation;
    2. to the extent that I am exposed to the personal information of other employees or third parties, be bound by appropriate and legally binding policies and obligations relating to confidentiality and non-usage of such personal information.
  5. I understand I have the right to lodge a complaint with the Information Regulator via email at complaints.IR@justice.gov.za
  6. I understand that the NHA will process my personal information in line with applicable legislation including the Act.

By submitting this form I hereby agree to the disclosure of my personal information:

  1. to any third party where the NHA has a legal duty or contractual obligation to do so;
  2. for any reason to enable the NHA to carry out or comply with any business obligation it may have to pursue a legitimate interest to perform its day-to-day business; and
  3. anywhere the NHA has outsourced a specific function to a third party.
