The National Horseracing Authority confirms that at an inquiry held in the Stipendiary Stewards Boardroom at the Vaal Racecourse on Monday 17 August 2020, Jockey D L Habib was charged with a contravention of Rule 58.10.2 (read with Guideline M on the use of the crop). The particulars of the charge being that he struck THE SASH more than twelve (12) times in Race 5 run at Turffontein Racecourse on 8 August 2020.
The National Horseracing Authority confirms that at an Inquiry held in Durban on 14 August 2020, Trainer Mr M L Roberts was charged with a contravention of Rule 73.2.3. The particulars being that he was the trainer of the horse STATUTE, from which a specimen taken prior to the running of the 6th Race at the Hollywoodbets Greyville Racecourse on 20 June 2020, disclosed upon analysis the presence of Flunixin, a prohibited substance (classified as a class 4 substance in terms of the Guidelines).
The National Horseracing Authority confirms that at an inquiry held in Port Elizabeth on 23 July 2020, Jockey Xolane Ndlovu was charged with a contravention of Rule 62.2.1. The particulars of the charge being, that as the Rider of ROSE A VELDT, he failed to take all reasonable and permissible measures from approximately the 300m to the 100m, to ensure that this horse was given a full opportunity to win or obtain the best possible placing in Race 1 at Fairview Racecourse on 6 July 2020.
The National Horseracing Authority confirms that at an Inquiry held in Durban on 22 July 2020, Jockey Gavin Lerena was charged with a contravention of Rule 62.2.3. The specifics of the charge being that on 15 July 2020, in Race 1, run at Hollywoodbets Greyville Racecourse, he failed to ride IN TIME ‘N TUNE out to the end of the race, thereby prejudicing his chances of obtaining 3rd position.
The National Horseracing Authority confirms that at an inquiry held at its offices in Johannesburg on 13 March 2020, Trainer Michael Mahiakola was charged with a contravention of Rule 10.5.1. The particulars being, that as a licensed Trainer, he failed to provide a reasonable level of care, treatment and training to the horses under his control, which resulted in horses showing on examination, poor condition and consequently the NHA having to intervene and provide independent veterinary care.
Mr Mahiakola pleaded guilty to the charge and was found guilty of the charge.
The Inquiry Board, when determining a penalty, took into account the evidence presented, factors put forward in mitigation, as well as Mr Mahiakola’s clean record and imposed a penalty of a fine of ten thousand rand (R10 000). Furthermore, Mr Mahiakola’s Trainer’s licence was cancelled. This cancellation is wholly suspended for a period of three (3) years, provided that during the period of suspension he is not found guilty of a contravention of a similar charge.
Mr Mahiakola has the Right of Appeal against the penalty imposed.
The National Horseracing Authority confirms that at an Inquiry held at its offices in Johannesburg on 11 March 2020, Assistant Trainer Thabiso Nako was charged with a contravention of Rule 72.1.10, in that he ill-treated the horse PIDGEON ROCK by striking its hindquarter with an inappropriate object at Randjesfontein Training Centre on 30 January 2020.
Assistant Trainer Nako pleaded not guilty to the charge but was found guilty of the charge.
The Inquiry Board, when considering a penalty, took into account the mitigating circumstances that surrounded the incident, as well as Assistant Trainer Nako’s record and imposed a penalty of a fine of four thousand rand (R4000.00).
Assistant Trainer Nako has the Right of Appeal against both the finding and the penalty imposed.
The National Horseracing Authority confirms that at an inquiry held at its offices in Johannesburg on Wednesday, 11 March 2020, Trainer Mr C E Erasmus was charged with a contravention of Rule 73.2.4. The particulars being, that he was the Trainer and the person responsible for the horse EMILY JAY, which ran in and won the 3rd race run at Turffontein Racecourse on 14 December 2019. A urine specimen, taken from EMILY JAY disclosed upon analysis the presence of Flunixin which is a prohibited substance in terms of the Rules.
Mr Erasmus pleaded not guilty to the charge, but was found guilty of the charge.
The Inquiry Board, after careful deliberation and taking into account Mr Erasmus’ mitigating factors that he put forward, as well as his record, imposed a penalty of a fine of R23 000.
Mr Erasmus has the Right of Appeal against both the finding and penalty imposed.
Furthermore, in terms of Rule 72.3.2, EMILY JAY is disqualified from the said race and the provisions of Rule 67.7.8 shall apply.
The National Horseracing Authority confirms that at an inquiry that commenced at its offices in Johannesburg on Monday 10 February 2020 and concluded on Friday 6 March 2020, Mr Larry Wainstein was charged with contravening Rules 72.1.25 and 72.1.26.
The particulars being that he conducted himself in an improper manner whilst present in the Stipendiary Stewards’ Boardroom at Turffontein Racecourse on Saturday, 30 November 2019.
Mr Wainstein pleaded guilty to the charges and was found guilty of the charges.
The Inquiry Board imposed a penalty of a fine of R50 000, of which R30 000 is wholly suspended for a period of 36 months provided that during the period of suspension he is not found guilty of a contravention of Rules 72.1.25 and 72.1.26.
The National Horseracing Authority confirms that at an Inquiry held in Durban on 14 February 2020, Trainer Frank Robinson was charged with a contravention of Rule 72.1.25, in that he conducted himself in an improper manner at Hollywoodbets Greyville Racecourse on 12 January 2020, by initiating a physical altercation with an employee of his stable.
Mr Robinson pleaded not guilty to the charge.
The Inquiry Board found Mr Robinson guilty and after considering the evidence presented, he was fined R8 000, of which R4 000 is suspended for a period of two years, provided that he is not found guilty of a contravention of Rule 72.1.25 during that time.
Mr Robinson has the Right of Appeal against the finding and the penalty imposed.
The National Horseracing Authority confirms that at an Inquiry held at its offices on Tuesday, 11 February 2020, Mr Mark Sham was charged with a contravention of:
Rules 72.1.25 and 72.1.26.
The particulars being that he conducted himself in an improper manner on racecourse property, which might have had the effect of discrediting horseracing and which did or might have brought into disrepute the good name of the National Horseracing Authority on 15 January 2020 at the 138th Annual General Meeting held at its offices at Turffontein Racecourse.
Mr Sham pleaded not guilty to the charge, but was found guilty of the charge.
The Board after considering the evidence led, and taking into account the arguments in aggravation and mitigation, ruled that Mr Sham be fined the sum of thirty thousand rand (R30 000) of which fifteen thousand rand (R15 000) is suspended for a period of twenty-four months, provided that Mr Sham is not found guilty of a similar offence under these Rules during this period.
Mr Sham has the right of appeal against both the finding and the penalty imposed.
